English summary: From August 17th 2015 EU inheritance law will completely change the way that international procedural law and conflict of laws with regard to international inheritance cases are regulated in EU member states. Due to transitional regulations, the legislation will even have to be taken into consideration by legal practices in advance of this date. An understanding of habitual place of residence as the new objective connecting factor will be of key importance for those applying the law in the future. Michael Kranzle examines the concept of habitual place of residence in the context of existing EU legislation and compares it with the concept of domicile, which is a widespread connecting factor in common law jurisdictions. Based on the insights gained, he develops a self contained definition of terms within the specific context of international inheritance law, which will help to provide convincing solutions for a host of difficult cases.

German description: Ab 17. 8.2015 wird die EU-Erbrechtsverordnung das internationale Verfahrens- und Kollisionsrecht fur internationale Erbfalle in den EU-Mitgliedstaaten umfassend neu regeln. Schon vor diesem Datum muss die Verordnung von der rechtsberatenden Praxis auf Grund von Ubergangsvorschriften berucksichtigt werden. Von zentraler Bedeutung wird fur den Rechtsanwender kunftig das Verstandnis des neuen objektiven Anknupfungspunktes des gewohnlichen Aufenthalts werden. Michael Kranzle untersucht den Begriff des gewohnlichen Aufenthalts im Kontext bisheriger EU-Rechtsakte und stellt ihn rechtsvergleichend dem in den Common-Law-Rechtsordnungen verbreiteten Anknupfungspunkt des Domicile gegenuber. Ausgehend von den gewonnenen Erkenntnissen wird ein eigenstandiges Begriffsverstandnis fur den spezifischen Kontext des internationalen Erbrechts entwickelt, anhand dessen sich zahlreiche problematische Fallgruppen uberzeugend losen lassen.
