Dominik Moser untersucht diese Modellregelungen hinsichtlich der Fragen, inwieweit das Vorliegen einer Stellvertretung der anderen Partei offenbart werden muss, und welche Rechtsfolgen sich hieraus ergeben. Dabei nimmt der Autor die Regelungen des deutschen und des englischen Rechts als Vertreter der kontinental-europaischen Rechtstradition einerseits und des Common Law andererseits zum Ausgangspunkt.
