English summary: The decision as described in Article 249 Paragraph 4 of the Treaty establishing the European Community is undoubtedly that form of taking action in European Community law which up to now has been given little attention by legal experts. Matthias Vogt bases his work on a broad review of the practice of law-making and develops a typology of decisions. He shows that decisions are much more than the Community law counterpart to the administrative act in domestic law. The decision surpasses all the other instruments of Community law not only in the flexibility of the way it is used but also in the heterogeneity of the legal rules to be applied. Up to now, too little significance has been attached to the decision as a central component of the European legislative-administrative association, especially in the field of normative control.


German description: Die Entscheidung nach Art. 249 Abs. 4 des EG-Vertrages ist zweifelsohne diejenige Handlungsform des Europaischen Gemeinschaftsrechts, die im Schatten von Verordnung und Richtlinie bisher vergleichsweise wenig rechtswissenschaftliche Beachtung gefunden hat. Matthias Vogt versucht es, einen Teil dieses Ruckstandes aufzuholen. Er geht dabei von einer breit angelegten Bestandsaufnahme der Rechtsetzungspraxis aus und entwickelt auf dieser Grundlage eine Typologie der Entscheidung. So kann gezeigt werden, dass die Entscheidung weit mehr ist als das gemeinschaftsrechtliche Pendant zum nationalrechtlichen Verwaltungsakt. Sowohl in der Flexibilitat ihrer Verwendungsweise als auch in der Heterogenitat des anzuwendenden Rechtsregimes ubertrifft die Entscheidung alle anderen Instrumente des Gemeinschaftsrechts. Insbesondere im Bereich der normativen Steuerung kommt ihr als zentraler Bestandteil des europaischen legislativ-administrativen Verbundes eine bislang zu wenig beachtete Bedeutung zu. Diese naher zu beleuchten und ihre Implikationen fur die Europaische Handlungsformenlehre zu entwickeln ist das zentrale Anliegen der Arbeit.
