English summary: Exclusive rights control the access to immaterial commodities and therefore they collide with behavioral communications within social systems, especially informal systems of exchange that permeate the digital world. Such conflict and ambiguity is visibly clear in cases of desist notices that structure the common technological field and is similar to cases of scholarship and education for which copyright law does not always provide adequate standards. These problems will only intensify in those cases that concern control of technological access. On the other hand, copyright law makes possible free and non-obligatory access to information (e.g. Open Source). The collected studies assembled in this volume clarify the mutual stimulation from copyright law and its environment. These studies investigate the cases of conflict from the political, economic, and theoretical legal perspectives and attempt to answer the question of what an environmentally sensible copyright law might look like.

Deutlich sichtbar wird das in Abmahnfallen, die die Kommunikationsstrukturen der familiaren Sphare betreffen. Ahnliches gilt fur Wissenschaft und Lehre, denen das Urheberrecht nicht immer adaquate Vorgaben macht. Verscharft wird dieses Problem, sollten technische Zugangskontrollen eine Renaissance erleben. Andererseits ermoglicht das Urheberrecht einen freien und freibleibenden Zugang zu Informationen (Open Source). Die in diesem Band versammelten Beitrage beleuchten die wechselseitigen Irritationen von Urheberrecht und seiner Umwelt. Sie untersuchen den Kollisionsfall aus politischer, okonomischer und rechtstheoretischer Perspektive und versuchen die Frage zu beantworten, wie ein umweltsensibles Urheberrecht aussehen konnte.
