English summary: Alexander Proelss addresses the avoidance and resolution of jurisdictional conflicts between Federal Constitutional Court of Germany (Bundesverfassungsgericht or BVerfG) on the one side and courts with supranational jurisdiction, especially the European Court of Justice, the European Court for Human Rights and the International Court of Justice on the other side. Such jurisdictional conflicts have arisen from the overlapping of legal competencies within a multi-level system of peaceful conflict resolution. From the vantage of position law, the author analyses the applicability, dogmatic positioning, scope and consequences of the procedural and functional mechanisms as well as the test-cases for constitutional law and the standing process of judicial review through which ultimately determine the jurisdiction of the Federal Constitutional Court.

German description: Alexander Proelss widmet sich der Vermeidung und Losung von Rechtsprechungskonflikten zwischen dem Bundesverfassungsgericht einerseits und der uberstaatlichen Gerichtsbarkeit, insbesondere dem Gerichtshof der Europaischen Union, dem Europaischen Gerichtshof fur Menschenrechte und dem Internationalen Gerichtshof andererseits. Diese Konflikte konnen sich aus der Uberlagerung gerichtlicher Zustandigkeiten im Rahmen des bestehenden Mehr-Ebenen-Systems der friedlichen Streitbeilegung ergeben. Vom Standpunkt des positiven Rechts aus analysiert der Autor Anwendbarkeit, dogmatische Verortung, Reichweite und Konsequenzen von prozeduralen und prozessualen Mechanismen, die den verfassungsgerichtlichen Prufungsmassstab bzw. die entsprechende Kontrolldichte und damit letztlich die Kompetenzen des BVerfG determinieren.
