He then gives a comprehensive analysis of the main applications of constitutional and administrative disputes between public bodies in the law currently in force. Based on this, he attempts to clarify the content, function and enforcement procedures of subjectivized legal positions within the organization. The author questions if and to what extent concrete powers within a government organization can be allocated to material principles of organization, such as for example the principles of democracy and of the separation of powers. He shows the conclusions that can be drawn from this in relation to the development of the procedural principles of the dispute between public bodies.

German description: Rainer Grote zeichnet zunachst die Entwicklung und Funktion der im staatsrechtlichen Positivismus und in Auseinandersetzung mit ihm vertretenen Organlehren fur die Interpretation staatsorganisatorischer Grundstrukturen nach. Anschliessend erstellt er eine umfassende Bestandsaufnahme der Hauptanwendungsgebiete verfassungs- und verwaltungsrechtlicher Organstreitverfahren im geltenden Recht unter Einbeziehung rechtsvergleichender und europarechtlicher Aspekte. Auf dieser Grundlage wird im dritten Teil der Versuch einer Klarung von Inhalt, Funktion und Durchsetzungsmodalitaten subjektivierter innerorganisatorischer Rechtspositionen unternommen. Der Autor untersucht, ob und in welchem Umfang konkrete innerorganisatorische Berechtigungen sich materialen Organisationsprinzipien wie dem Demokratie- und dem Gewaltenteilungsprinzip zuordnen lassen, die uber ihre kompetenzielle Ausformung im Staats- und Verwaltungsorganisationsrecht den zustandigen Verfassungs- und (Selbst-) Verwaltungsorganen ein jeweils abgestuftes Mass an politischer oder zumindest funktionaler Autonomie vermitteln und damit als regulative Prinzipien der intra- und zwischenorganschaftlich ablaufenden Kommunikationskreislaufe fungieren. Er zeigt auf, welche Folgerungen sich daraus fur eine Weiterentwicklung der prozessualen Grundlagen des Organstreits ergeben.
